Your kind co-operation is requested in adhering to the following.
1. Minimum deposit of $50 is required as a retainer the day
of the shoot.
2. The balance owed must be received before any photographs
will be mailed or given to the client.
4. Proofs and high resolution digital files will be delivered
in approximately two to three weeks from the photo shoot.
5. If Melinda Mercer Photography, division
of Wind River Productions Inc. is
unable to perform to the guide lines of this contract due
to a fire or other casualty, strike, act of God, act of terrorism,
or other cause beyond the control of the parties, or due to
the photographer Melinda Mercer's illness and if Melinda Mercer
Photography,division
of Wind River Productions Inc.
is unable to provide a photographer that is agreeable to the
client then all fees paid by the client will be returned in
full, but Melinda Mercer Photography shall have no further
liability with respect to the agreement. If Melinda Mercer
Photography is unable to perform to the obligations in this
contract for any other reason, Melinda Mercer Photography,division
of Wind River Productions Inc.
will not be liable for costs in excess of the amount the client
has paid. This limitation of liability will also apply in
the event that the high resolution digital files are lost
through camera malfunction, damaged in processing, lost in
the mail, or otherwise damaged or lost without fault of the
photographer Melinda Mercer . While every attempt is made
to create the best images possible, no particular photo is
guaranteed.
6.Images may be used for personal use only, and may not be
sold or published without the written consent of Melinda Mercer.
7. All rights to images created by Melinda Mercer will remain
with the photographer. Melinda Mercer reserves the right to
display any photographs made in conjunction with this as samples
of her work for the purposes of window and showroom exhibit,
advertising, promotion on the internet, publication, instruction
and professional competition.
8. Travel : No charge within 30 miles of Daphne, Al. Mileage
is .50 per mile extra over 30 miles.
