Terms & Conditions

Your kind cooperation is requested in adhering to the following.

Service Coverage: The parties agree that Melinda Mercer will furnish the photographic services for________ hours of photographic event coverage beginning at _____ and ending at _____.Additional hours of coverage can be added for $250 an hour w / rights. Melinda Mercer will be the sole professional still photographer employed at the event. Family and friends are welcome to take candid photos at the reception and any situation that is not posed by Melinda Mercer. No flash photography will be allowed while Melinda Mercer is posing.
It will be the client's responsibility to communicate with family, guests and other vendors of the above restrictions, and to enforce such restrictions. Initial that you have read and accept terms:_____

Payment Policy and Expenses: A signed contract and retainer are required to reserve the specified coverage. Minimum of $500 is required as a retainer. All retainers are nonrefundable and nontransferable, in the event of a date change or wedding cancellation for any reason. The remaining balance is due 30 days prior to the wedding ceremony. Client is responsible for final payment reaching our office by the due date. All fees paid are non-refundable and non-transferable. Non-payment of any fees releases Melinda mercer from any and all obligation defined in this agreement. ______

Product Pricing: Pricing is defined on the attached sheet. Melinda Mercer guarantees that all prices quoted for professional services, including photographs and albums are valid for a period of three months following the date of the wedding. Orders placed after this period, are billed at the studio's current pricing, which may be greater._____

Copyright :All photographs by Melinda Mercer or David Mercer are subject to copyrights of the professional photographer listed above and are protected by the Copyright Law of the United States (Title 17, United States Code) and by the Berne Convention. Reproduction, or transmittal by any means, of any image, whole or in part, is prohibited without express prior written permission. Prints purchased from this Melinda Mercer may not be reproduced or scanned for any reason and may only be used for personal display. If you wish to publish or reproduce the materials in any physical or digital form or use them for any commercial purpose, including display or Web page use, you must obtain prior written permission from the photographer listed above. Prints provided to clients on CD or DVD are for personal use only.

Ownership of Images: Melinda Mercer will provide the client with a CD of high resolution files if purchased. The images are to printed for personal and family use only. The client is not allowed to sell or publish the images.

Entire agreement: This agreement contains the entire understanding between Melinda Mercer Photography and the CLIENT. It supersedes all prior and simultaneous agreements between the parties. The only way to add or change this agreement is to do so in writing, signed by all the parties. If the parties want to waive one provision of this agreement, that does not mean that any other provision is also waived. The party against whom a waiver is sought to be effective must have signed a waiver in writing.

Cooperation: It is understood and agreed that no other photographer will be allowed to photograph or take pictures at the wedding while the Photographer is working. The parties agree to cheerful cooperation and communication for the best possible result within the definition of this assignment. Melinda Mercer Photography recommends that CLIENT designate an "event guide" to point out important individuals for informal or candid photographs to the photographer during the wedding that they wish to have photographed. The photographer will not be held accountable for not photographing desired people if there is no one to assist in identifying people or gathering people for photograph's. Melinda Mercer Photography is not responsible if key individuals fail to appear or cooperate during photography sessions or for missed images due to details not revealed to Melinda Mercer Photography. Photographing any specific moment is not guarantee by Melinda Mercer Photography and she will not be responsible for any missed moments. The client may present Melinda Mercer Photography with a list of suggested photos, but Melinda Mercer is unable to guarantee that those suggested photos, or any image will be captured.

Online proofs, reviewing and selection: will be available in approximately three to four weeks from the wedding date.

Limited Liability: If Melinda Mercer is unable to perform to the guide lines of this contract due to a flood, fire or other casualty, strike, act of God, act of terrorism, threat of a flu pandemic or disease epidemic, or other cause beyond the control of the parties, or due to the photographer Melinda Mercer's illness then all fees paid by the client will be returned in full, but Melinda Mercer Photography shall have no further liability with respect to the agreement. The amount of liability cannot exceed the amount of the contract.. This limitation of liability will also apply in the event that the high resolution digital files are lost through camera malfunction, damaged in processing, lost in the mail, or otherwise damaged or lost with or without fault of the photographer Melinda Mercer. While every attempt is made to create the best images possible, no particular photo is guaranteed. Client(s) agree that an entire wedding cannot be replicated, reenacted or repeated for the purpose of a reshoot and limits Studio's liability to the amount paid under this contract. In the unlikely event of personal illness or other circumstances beyond the control of Melinda Mercer, a substitute photographer of high qualifications may be dispatched by Melinda Mercer to full fill the obligations of photography herein contracted. ____

Attorney fees and costs: Client will be liable for all costs of debt collections under the contract including all legal fees.

Time: Coverage plan times must be used consecutively. Time starts when Melinda Mercer Photography arrives and the time finishes when the coverage time runs out. By signing of this contract the photographer and the clients agree to all terms & conditions stated in this contract.

Travel: No charge within 30 miles of Daphne, Al. Mileage is $1 per mile extra over 30 miles. Travel over 120 miles will include a hotel. Travel over 300 miles may airfare, hotel, taxis, meals and hotel & airport transfers.

Model Release: The CLIENT hereby grants to Melinda Mercer Photography and its legal representatives and assigns, the irrevocable and unrestricted right to use and publish photographs of the CLIENT or in which the CLIENT may be included, for editorial, trade, advertising and any other purpose and in any manner and medium; to alter the same without restriction; and to copyright the same. The CLIENT hereby releases Melinda Mercer Photography and its legal representatives and assigns from all claims and liability relating to said photographs All rights to images created by Melinda Mercer will remain with the photographer. Melinda Mercer reserves the right to display any photographs made in conjunction with this wedding as samples of his work for the purposes of window and showroom exhibit, advertising, promotion on the Internet, publication, instruction and professional competition.

Disclaimers: Melinda Mercer is not responsible for lost photo opportunities due to other people's camera or flash, or the lateness of the bride, groom, family and bridal party.

Melinda Mercer charges a $35 fee on any and all returned checks.

Food and Beverage should be provided for the photographers..

The contract is not a "work for hire."

The client agrees to keep the studio informed of any and all changes of address information of party to the contract.

I / we, the undersigned Contracting Party, hereby warrant that I am / we are competent to contract in my / our own name(s). I / we confirm that I / we have read the herein agreement prior to its execution and I / we are fully familiar with the contents thereof. This agreement shall be binding upon us and our heirs, legal representatives and assigns. And, we certify that we have received a complete copy of this agreement with all blank lines completed.
